A Bronx cab driver is being charged with manslaughter after he viciously beat a man to death who tried to rape his wife inside his apartment. 

Mamadou Diallo, 61, was called by his wife and other family members after Earl Nash, 43, broke into their apartment, assaulted her, exposed himself and tried to rape her, according to the NY Daily News. The wife and a female cousin fought him off for 20 minutes after he banged on their apartment door and forced himself inside. “He came in and punched her,” said Ibrahima Diallo, Mamadou’s sister in-law to the Daily News.  When Diallo arrived, he chased Nash into the sixth floor elevator and proceeded to beat him with a tire iron. He ended up fracturing the would-be rapist’s skull, and he died at Lincoln Hospital later that night. Diallo is being charged with manslaughter, according to officials. His brother, Ibrahima, 52, said Nash instigated the fight. “The guy punched him, he started fighting” he said to the Daily News. “This man said he’s gonna kill him, kill his family.” Some of his neighbors defended Diallo’s actions. “He has the right to defend his wife,” said Katiatou Diallo who is not related to Mamadou. “What are you going to do if somebody comes in and tries to rape your wife?”

Diallo’s son witnessed the rape and saw Nash after the beat down at then hands of his father. “He started beating on my mother and my aunt, and they starting fighting back,” he said to NBC. “He tried to rip their clothes off and he tried to sexually harass them. I ran upstairs and saw the guy was in the elevator and he was bleeding, and my mother was sweating, her clothes were off. I didn’t know what to think.” Nash has 19 prior arrests and was released from prison last year after a serving 9 years for bribery and drug possession.
